These terms apply in favour of Malyte and any individual, company, or legal entity that owns, operates, manages, or is otherwise responsible for the Malyte platform and website, now or in the future.
Malyte ("we", "us", "our", "the Platform") is an AI-powered wellness marketplace that connects wellness professionals ("Sellers") with individuals seeking personalised wellness plans ("Buyers"). The Platform is operated under the Malyte brand. These Terms apply to all users of the Platform, including Sellers, Buyers, and visitors.

By registering an account, purchasing a product, listing a product, or otherwise using the Platform, you confirm that:

Malyte acts as an intermediary platform and technology provider. Malyte does not itself provide medical, nutritional, fitness, or health advice. All content generated through the Platform is based on Seller-provided methodologies and is for informational and personal development purposes only.
To access certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hello@malyte.com if you suspect unauthorised access to your account.
We reserve the right to suspend or permanently terminate any account, at our sole discretion, without prior notice, if we believe the user has violated these Terms, engaged in fraudulent activity, or poses a risk to the Platform or other users.
To become a Seller on Malyte, you must be a qualified wellness professional or have demonstrable expertise in your stated field. By listing on the Platform, you represent and warrant that the methodology you upload is your own original work or that you have the right to use and commercialise it.
Sellers are solely responsible for the accuracy, legality, and quality of the methodology and content they upload. Malyte does not verify or endorse any Seller's qualifications, credentials, or methodologies. By uploading content, you grant Malyte a non-exclusive, worldwide, royalty-free licence to use, process, and display your content solely for the purpose of operating and improving the Platform.
Sellers may not upload content that:
Malyte charges a commission on Seller earnings as stated in the applicable fee schedule at the time of registration or as subsequently communicated. Payments are processed through Lemon Squeezy. Malyte reserves the right to modify its commission structure with reasonable notice to Sellers. Sellers enrolled in any promotional or beta programme may be subject to specific commission terms communicated separately.
Sellers are solely responsible for their tax obligations arising from sales made through the Platform, including VAT, income tax, and any other applicable taxes in their jurisdiction.
Plans generated through Malyte are AI-generated digital products based on Seller-provided methodologies and Buyer-provided personal information. They are provided for informational and personal development purposes only and do not constitute medical advice, diagnosis, or treatment.
Before starting any fitness, nutrition, or wellness programme, Buyers should consult a qualified healthcare professional. Malyte accepts no liability for any health outcomes, injuries, or adverse effects resulting from following plans generated through the Platform.
All purchases made through Malyte are final. Given the personalised and digital nature of the products, refunds are not available once a plan has been generated and delivered, unless the plan is materially defective or fails to be delivered due to a technical error on our part. Refund requests must be submitted within 7 days of purchase to hello@malyte.com.
Plans generated through Malyte use artificial intelligence technology. While we strive to ensure the quality and relevance of AI-generated content, we make no warranties regarding its accuracy, completeness, or suitability for any particular purpose. AI-generated content may contain errors or omissions. Users acknowledge and accept this inherent limitation.
All intellectual property rights in the Malyte Platform, including its software, design, branding, algorithms, and AI systems, are owned by or licensed to Malyte. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our prior written consent.
Sellers retain ownership of their uploaded methodologies and content. The licence granted to Malyte in Section 5.2 does not transfer ownership.
Plans generated for Buyers are for their personal use only and may not be resold, redistributed, or commercially exploited without the prior written consent of both Malyte and the relevant Seller.
To the fullest extent permitted by applicable law, Malyte and any individual, company, or entity that owns, manages, or operates Malyte shall not be liable for:
Our total aggregate liability to any user shall not exceed the amount paid by that user to Malyte in the 12 months preceding the event giving rise to the claim.
You agree to indemnify, defend, and hold harmless Malyte and any individual, company, or entity that owns, manages, or operates Malyte — including their respective officers, directors, employees, and agents — from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.
Malyte reserves the right to modify, suspend, or discontinue any part of the Platform at any time without notice. We also reserve the right to update these Terms at any time. Continued use of the Platform following any changes constitutes your acceptance of the updated Terms. We will make reasonable efforts to notify users of material changes via email or an in-platform notice.
These Terms are governed by and construed in accordance with the laws of Italy, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts of Italy, unless mandatory consumer protection laws in your country of residence provide otherwise.
If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Malyte with respect to your use of the Platform and supersede all prior agreements, representations, and understandings.
